• Choice of law

For all legal relationships between the parties, the law of the Federal Republic of Germany applies, excluding the laws on the international purchase of movable goods, in particular the UN sales law. For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer is habitually resident. 

• Place of jurisdiction

If the customer acts as a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Berlin, Germany. In this case, Galerie Gilla Loercher is also entitled to sue at the customer's registered office.

• Rechtswahl 
  Für sämtliche Rechtsbeziehungen der Parteien gilt das Recht der Bundesrepublik Deutschland unter Ausschluss der Gesetze über den internationalen Kauf beweglicher Waren, insbesondere des UN-Kaufrechts. Bei Verbrauchern gilt diese Rechtswahl nur insoweit, als nicht der gewährte Schutz durch zwingende Bestimmungen des Rechts des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, entzogen wird.

 

• Gerichtsstand Handelt der Kunde als Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtlichen Sondervermögens ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag Berlin, Deutschland. Galerie Gilla Loercher ist in diesem Fall auch berechtigt, am Sitz des Kunden zu klagen.
